Liability Waiver

PLEASE READ CAREFULLY — THIS IS A LEGALLY BINDING CONTRACT. By signing it, you give up important legal rights, including the right to sue.

1. Range Safety Rules

I acknowledge receiving, reading, and understanding the following range safety rules and agree to follow them and all instructions given by staff at all times:

  • Always treat every firearm as if it were loaded.
  • Always keep the firearm pointed in a safe direction — where a negligent discharge would cause minimum property damage and zero physical injury.
  • Always keep your trigger finger off the trigger and outside the trigger guard until you have made the conscious decision to shoot.
  • Always be sure of your target, backstop, and surroundings.
  • Eye and ear protection is required at all times during live fire. Eye protection: ANSI Z87.1 impact-rated wrap-around or prescription safety glasses with side shields. Ear protection: foam plugs or muffs with at least 35dB combined mitigation.
  • Shooters are encouraged to wear a billed hat to keep ejected brass from lodging behind safety glasses.
  • Never anticipate a command or instruction.
  • Load only after taking position on the firing line and the order to load is given. Load, unload, and reload only as instructed.
  • Never draw or holster a handgun with the finger in the trigger guard or on the trigger.
  • If a firearm starts to fall, DO NOT ATTEMPT TO CATCH IT. Internal safeties should prevent discharge; report it to an instructor for inspection.
  • Never holster a handgun with the hammer cocked unless the weapon is designed for single-action carry, with the safety engaged.
  • Never bend over the firing line unless instructed.
  • Never go forward of the firing line unless instructed.
  • Never remove a weapon from the holster on the range unless instructed.
  • Safety is everyone’s responsibility. Anyone who observes an unsafe act or condition may call a cease fire and report it to an instructor.

2. Acknowledgment & Assumption of Risk

I understand that firearms handling, target shooting, and firearms training are inherently dangerous activities that involve the risk of serious bodily injury, permanent disability, paralysis, hearing and vision loss, burns, lead and chemical exposure, property damage, and death. These risks may arise from my own actions or inactions, those of others, the condition of firearms, ammunition, equipment, or the Facility, or the ordinary negligence of the Released Parties. I knowingly, voluntarily, and freely assume all such risks, whether known or unknown, and accept full responsibility for any resulting injury, damage, loss, or death.

3. Participant Representations & Eligibility

I represent and warrant that: I am not prohibited from purchasing, possessing, receiving, or handling firearms or ammunition under any federal, state, or local law (including 18 U.S.C. § 922(g)); I am in adequate physical and mental condition to participate safely; I am not, and during the Activities will not be, under the influence of alcohol, marijuana, drugs, or any medication that could impair judgment, coordination, or safe firearm handling; and I will obey all safety rules and staff directions. Black Watch Group LLC may refuse or remove any person who appears impaired, unfit, unsafe, or prohibited from possessing firearms — without refund.

4. Medical Treatment & Expenses

The Released Parties have no duty to provide medical care; any first aid or assistance is rendered voluntarily as a courtesy. I consent to receive emergency medical treatment if needed and am solely responsible for all medical expenses arising from my participation.

5. Release & Waiver of Liability

On behalf of myself and my heirs, executors, administrators, personal representatives, and assigns, I release, waive, and forever discharge the Released Parties from any and all claims, demands, liabilities, and causes of action of any kind — including those arising from the ordinary negligence of the Released Parties — for any injury, disability, death, property damage, or loss arising out of my presence at the Facility or participation in the Activities. This release does not apply to gross negligence, recklessness, or willful or wanton misconduct, or to any liability that may not be released as a matter of law.

6. Covenant Not to Sue

To the fullest extent permitted by law, I agree not to sue, make a claim against, or bring any proceeding against any of the Released Parties for any matter released under Section 5.

7. Indemnification & Hold Harmless

I agree to indemnify, defend, and hold harmless the Released Parties from any and all claims, demands, causes of action, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of: (1) my use of the Facility; (2) any training received; (3) my use of any firearms, ammunition, vehicles, equipment, or materials; or (4) my breach of this Agreement or violation of any law — except claims arising from the Released Parties' gross negligence, recklessness, or willful or wanton misconduct.

8. Governing Law, Venue & Severability

This Agreement is governed by the laws of the State of Utah, and the exclusive venue and jurisdiction for any dispute is the state and federal courts located in Utah, to whose personal jurisdiction I consent. If any provision is held invalid or unenforceable, it shall be modified and enforced to the greatest extent permitted by law and the remaining provisions remain in full effect. My assumption of risk, covenant not to sue, and indemnification obligations survive even if the negligence release in Section 5 is held unenforceable.

9. Voluntary Execution

I certify that I have read this entire Agreement, fully understand it, have had the opportunity to ask questions and to consult an attorney, and am signing it freely and voluntarily. This Agreement is intended to be as broad and inclusive as the law permits.
